It is time citizens march to Aso rock and chase this useless president out of office.No country in the world will tolerate this foolishiness from a clueless leader one day longer.It is time the citizens get up and take their country back from this bandit.
What is going on in nigeria is unheard of anywhere in the world.OBJ has made Abacha and Babangida saints, by his reckless and out of touch with the citizen's needs.

Gani sues Obasanjo over N7bn library fund

ABUJA— THE controversy over the Olusegun Obasanjo Presidential Library (OOPL) yesterday deepened with the Federal High Court sitting in Abuja set to rule on whether or not the President abused his office and violated the constitution in initiating the project.

The court was also challenged to order the Economic and Financial Crimes Commission (EFCC) to investigate all the contracts awarded by the Federal Government from 1999 to date “in so far as the donors of the gifts of money received at the launch of the Presidential Library at Abeokuta, Ogun State on May 14, 2005 are involved in such contracts and for the Economic and Financial Crimes Commission (EFCC) and the Independent and Corrupt Practices Commission (ICPC) to take appropriate actions against the President and the donors."

Frontline human rights crusader and lawyer, Chief Gani Fawehinm (SAN)i, who filed the writ in Abuja claimed that President Obasanjo violated section 15 (5) of the constitution which states: “The state shall abolish all corrupt practices and abuse of power.” He said President Obasanjo also abused Item 1 Fifth Schedule, Part 1 of the Constitution which states that “A public officer shall not put himself in a position where his personal interest conflicts with his duties and responsibilities.”

Chief Fawehinmi alleged that the President also “flagrantly disregarded” the Code of Conduct for public officers contained in Item 6 (1) (2) of the Fifth Schedule, Part 1 of the Constitution which states in 6(1) A that: “A public officer shall not ask for or accept property or benefits of any kind for himself or any other person on account of anything done or omitted to be done by him in the discharge of his duties.
(2) “For the purposes of sub-paragraph (1) of this paragraph, the receipt by a public officer of any gifts or benefits from commercial firms, business enterprises or persons who have contracts with the government shall be presumed to have been received in contravention of the said sub-paragraph unless the contrary is proved.”

Government is expected to react within eight days whether as a serving President, President Obasanjo breached the constitution by receiving gifts from Federal Government contractors both local and foreign.
Chief Fawehinmi also wants the court to determine whether in view of section 22 of the constitution, the mass media have a right to have access to the declaration of assets filed in the Code of Conduct Bureau by President Obasanjo.

The court will also determine whether the chairmanship of the board by Nigeria's High Commissioner in London, Dr. Christopher Kolade; the membership of a serving governor, Otunba Gbenga Daniel; and a serving Commissioner of Health in Ogun State, Dr. Iyabo Obasanjo-Bello; and Messrs Karl Masters Vernon Jordon (USA) and Richard Brandson (UK) being foreigners of the Board of Trustees of Olusegun Obasanjo Presidential Library at Abeokuta contravene the provisions of Sections 15(5) and 23 of the Constitution of the Federal Republic of Nigeria
The writ wants the court to declare that the gift of money to the President at the launch by various contractors to government and other beneficiaries of government policies and programmes including Alhaji Aliko Dangote and his group of companies, Chief Mike Adenuga Jr. and his companies, oil firm majors, consortium of banks and others who are benefitting or have benefitted from policies and programmes of President Obasanjo’s government contravenes Section n15 (5) of the Constitution.
Other reliefs sought by Chief Fawehinmi include:

lA mandatory order directing the Economic and Financial Crimes Commission (EFCC) and the Independent Corrupt Practices Commission (ICPC) to investigate all the contracts awarded by the Federal Government from 1999 to date in so far as the donors of the gifts of money received at the launching of the Olusegun Obasanjo Presidential Library at Abeokuta, Ogun State on Saturday, 14th May, 2005 are involved in such contracts and for the Economic and Financial Crimes Commission (EFCC) and the Independent Corrupt Practices Commission (ICPC) to take appropriate actions against the President and the donors of the said gifts of money within the provisions of the Economic and Financial Crimes Commission (Establishment) Act No. 1 of 2004 and the Corrupt Practices and Other Related Offences Act respectively, including forfeiture of (a) the entire project (b) Olusegun Obasanjo Presidential Library Fund if there is contravention of any of the two Acts i.e. EFCC and ICPC, by the President of the Federal Republic of Nigeria, General Olusegun Obasanjo.

lA mandatory order compelling the 4th Defendant, Code of Conduct Bureau to publish or allow the mass media pursuant to their duties under Section 22 of the Constitution of the Federal Republic of Nigeria, 1999 access to the declaration of assets filed in the Code of Conduct Bureau by the President of the Federal Republic of Nigeria, General Olusegun Obasanjo before he assumed office as President in 1999.

lA declaration that the composition of the Board of Trustees of Olusegun Obasanjo Presidential Library being a private project of a serving President is both a violation of Sections 15(5) and 23 of the Constitution
of the Federal Republic of Nigeria, 1999 in that:
(a) the Chairmanship of Dr. Christopher Kolade, a serving public officer being the Nation*s High Commissioner in Britain is incompetent to spend public time and money to serve*General Olusegun Obasanjo’s private business;

(b) the membership of Otunba Gbenga Daniel, a serving public officer who is the Governor of Ogun State is incompetent to spend public time and money for President Olusegun Obasanjo private business;
the membership of Dr. Iyabo Obasanjo-Bello who is a serving public officer and Commissioner for Health in Ogun State is incompetent. to spend public time and money to serve a private project of a serving President, General Olusegun Obasanjo, her father.

lThe membership of Messrs Karl Masters, Vernon Jordan (USA) and Richard Branson (UK) who are foreigners are incompetent to serve the private project of a serving President of Nigeria in that their identities are unknown to Nigerians as the national security of Nigeria can be compromised in this respect and in particular Mr. Richard Branson is a substantial shareholder of the new National Carrier, Virgin Nigeria as well as a substantial shareholder of Vmobile Telecommunications which is now Virgin Mobile.

lA declaration that the entire establishment of Olusegun Obasanjo Presidential Library whilst President Olusegun Obasanjo is still a serving President amounts to abuse of office and is capable of engendering corrupt practices contrary to Section 15(5) of the Constitution of the Federal Republic of Nigeria, 1999 which provides as follows:

A declaration that the licence which the 1st Defendant, General Olusegun Obasanjo sitting as the Chairman of the Federal Executive Council meeting in 2003 approved for himself for the establishment of the Bells University of Technology to which the Olusegun Obasanjo Presidential Library will be affiliated is an abuse of power and is contrary to Section 15(5) of the Constitution of the Federal Republic of Nigeria, 1999.

He said:lThat among the donors are many businessmen and companies that have been beneficiaries of large contracts from the Federal Government of Nigeria since General Olusegun Obasanjo came to power in 1999, notably Alhaji Aliko Dangote and his Group of Companies, Chief Mike Adenuga and his companies, oil firm majors, consortium of banks and others.
lThat General Olusegun Obasanjo set up a board of trustees for the Olusegun Obasanjo Presidential Library with the following members: Dr. Christopher Kolade as chairman who is a serving public officer (Nigeria High Commissioner in Britain) to serve in the private project of General Olusegun Obasanjo;

Otunba Gbenga Daniel as a member who is a serving public officer (Governor of Ogun State) to serve in the private project of General Olusegun Obasanjo; Dr. Iyabo Obasanjo-Bello as a member who is a serving public officer (Commissioner for Health, Ogun State) to serve in the private project of General Olusegun Obasanjo, her father; Messrs Karl Masters, Vernon Jordan (USA) and Richard Branson (UK) as members who are foreigners and whose true identities are unknown to Nigerians in view of the security implications to the nation.

lThat one of the members of the Board of Trustees of the Olusegun Obasanjo Presidential Library, Mr. Richard Branson (UK), recently negotiated a successful deal with the Federal Government of Nigeria after the Government of General Olusegun Obasanjo had successfully liquidated the National Carrier, Nigeria Airways whereby the Richard Branson’s Virgin Atlantic became the substantial shareholder of Virgin Nigeria Airline which is now the Nigeria National Carrier.

lThat in addition, Richard Branson’s company, the Virgin, has just bought over Vmobile Telecommunications as a majority shareholder which has now become Virgin Mobile, a beneficiary of President Olusegun Obasanjo privatisation policies and programmes.

lThat before the Olusegun Obasanjo Presidential Library fund was launched on Saturday, May 14, 2005 in Abeokuta, Ogun State, President Olusegun Obasanjo had done the architectural drawings of the Library project.
lThat the Federal Government has initiated and implemented policies and programmes including privatisation of public enterprises which has conferred enormous financial functions on some of the donors to the Olusegun Obasanjo Presidential Library Fund launched on Saturday, May
14, 2005.

The court was also tasked to declare that:

lthe Chairmanship of Dr. Christopher Kolade, a serving public officer being the nation’s High Commissioner in Britain is incompetent to spend public time and money to serve General Olusegun Obasanjo’s private business;

lthe membership of Otunba Gbenga Daniel, a serving public officer who is the Governor of Ogun State is incompetent to spend public time and money for President Olusegun Obasanjo’s private business;
lthe membership of Dr. Iyabo Obasanjo-Bello who is a serving public officer and Commissioner for Health in Ogun State is incompetent to spend public time and money to serve a private project of a serving President, General Olusegun Obasanjo, her father.

Until just a few days before the launching of Pres. Olusegun Obasanjo's Presidential Library, very few Nigerians had heard the name, Carlton Masters, let alone his company, Goodworks International, LLC. Goodworks is an Atlanta based lobbying firm founded by Obasanjo's long-time friend and former United States Ambassador to the United Nations, Andrew Young, and Carlton Masters, a naturalized American. Masters served as a former Deputy Minister of Trade and Agent-General to the United States for Ontario, Canada.

Interview with Carlton Masters: the man behind Obasanjo’s multi-million-dollar Private Library by Omoyele Sowore


Nigeria is a country that is bedeviled by hunger, unemployment, decayed infrastructure and most importantly a decimated educational system. President Obasanjo continues to thrive, having built for himself a multi-billion naira farm. He is also building a University known as “Bell University” to be based in Otta, Ogun State before or soon after he leaves office. The latest of these presidential initiatives is a $50 million privately funded Presidential Library for President Obasanjo when he leaves office, the completion of which is to coincide with his 70th birthday. By the admission of the man behind the project the Presidential Library will complete by March 6, 2007.


I tried to locate Mr. Carlton Masters in Nigeria when I got wind of his activities on behalf of the Presidential Library to which he is the Co-Chairman. When I first called him he was in the midst of the fund raising ceremony, he couldn’t speak to me he said. I gave him my number to call me back after telling him that I wanted to know what all these was about, especially knowing that he works for Goodworks International, a lobby group based in Atlanta, Georgia and Washington DC involved in an annual multi-million dollar contract with the government of Nigeria since 1999.

A few weeks ago, I read Sowore Omoyele's piece in the NigeriaWorld, entitled: "OBASANJO IS A KILLER, HE'S VERY CORRUPT AND VINDICTIVE." This account is based on his interview with Orji Uzor Kalu, the governor of Abia State. It is a very fascinating story.

Following the petition sent to the Economic and Financial Crimes Commission (EFCC) by Chief Gani Fawehini (SAN) alleging corruption and abuse of office against President Olusegun Obasanjo over the N6.5 billion Olusegun Obasanjo Presidential Library Project, the president is now being investigated.

Revealing this in a letter dated July 21, 2005 and signed by its Executive Chairman, Nuhu Ribadu, EFCC stated that investigation had already commenced on sundry allegations raised by Fawehinmi in his June 20, 2005 petition.

While acknowledging Fawehinmi’s efforts at supporting the commission with valuable materials, such as books, the letter said: "We are already investigating the allegations contained in the petition and assure you that we will give it the attention it deserves."

Ribadu also expressed gratitude to the human rights crusader for his "untiring effort in promoting good governance, probity and accountability in our dear country," adding: "We believe we are following your indelible footsteps and we assure you that we will continue to give our best in improving the lot of Nigerians. We will also continue to rely on your guidance and pray to Almighty God to continue to give good heal and protect you in order to continue your service for Nigeria and Nigerians."

It would be recalled that Fawehinmi had cried to the commission to investigate the N6.5 billion collected during the fund raising for the presidential library on the grounds that Obasanjo had acted unlawfully by using his office to raise fund for a private business.

Fawehinmi, in the petition, argued that Obasanjo’s action of My 14, 2005, when he organised the fund raising for the library project, offends section 98 of the Criminal Code Cap 29, Laws of Ogun State, 1978, which states that "any person who:- (1) being employed in the public service and being charged with the performance of any duty by virtue of such employments, not being a duty touching the administration of justice, corruptly asks, receives, or obtains, or agrees or attempts to receive or obtain any property or benefit of any kind for himself or any other person on account of any thing already done or omitted to be done, by him in the discharge of the duties of his office … is guilty of a felony, and is liable to imprisonment for seven years."

The petitioner had also alleged that the undertaking of fund raising by Obasanjo for the library project also violates sections 100 and 104 of Criminal Code, Cap 29, Laws of Ogun State of Nigeria, 1978.
In addition, Fawehinmi posited in his petition that the president grossly abused his office by awarding himself, in 2003, a licence to operate a private university, Bell University of Technology, an action which he said violated the provision of section 15 (5) of the constitution of the Federal Republic of Nigeria, 1999.

Fawehinmi had argued that those who donated at May 14, 2005 fund raising for the library project were "mostly contractors to Federal Government of Nigeria, who had benefited financially from the Federal Government since General Olusegun Obasanjo came to power on May, 1999."

Among those who donated for the Library project were captains of industries, like Alhaji Aliko Dangote, Chief Mike Adenuga Jnr, Femi Otedola and Alhaji Arisekola.

But will the investigation see the light of day. Or better question does Nuhu Ribadu have the balls to be the Kenneth Star of Nigeria, Better even if Ribadu Nuhu succeed in exposing Obasanjo which the dirt is there for all to see, will the those armed robbers at NASS do anything? the answer is capital NO, one Ghana must go will shot them up.

If you listened to NTA news this past few days, you would have known that EFCC already cleared OBJ and also warned those nigeria citizens telling EFCC about how to do their job to stop.

Documents published on the internet indicate that President Obasanjo's son, Gbenga, has bought a house worth $537,126.88 (about N76,271,892) in New York, United States.

Gbenga is alleged to have bought the house located at 705, Carol Street, Brooklyn, New York, through his agents, Isaac Erlich, Jonathan Ross and Jordana Beth Levine, all of 150, Seventh Avenue, Brooklyn, New York.

The house is said to have been registered on April 1, 2005 at the office of the city's registrar in the New York City department of finance.

An angry Gbenga went ahead to ask Daily Trust to "publish whatever you want to publish in your usual manner. The story is already on the internet. Call your colleagues in Lagos who also have the story but have not used it because they have done what they are supposed to do."

The Special Assistant to the President on Public Affairs, Chief Femi Fani-Kayode, declined comments on the matter.

He told Daily Trust on phone that it was Gbenga Obasanjo's private affair on which he has not been mandated to comment.

It will be recalled that in April this year, Gbenga Obasanjo was again in the news when it was alleged that he has about $20 million stashed in foreign accounts.

In defence of his son then, President Obasanjo said: "My son, Gbenga, has no money in his name. Someone said he has $20 million in his account. My family knows where I stand on this issue. They have a code of conduct."

"If they don't follow, they will be treated like anyone else and we have done well. The presidency in its totality is united in this war against corruption," the president said.

But the president's anti-corruption war song was interrupted last week when the Abia State Governor, Orji Uzor Kalu, in a letter, accused the president of a lukewarm attitude in his fight against corruption.

Governor Kalu accused the president of owning foreign accounts and also alleged that several deals in the oil sector were carried out by Obasanjo through his agents.

The president has however ordered the EFCC to investigate the matter.

Fighting hard to absolve himself of complicity in the burgeoning scandal, Gbenga said: "This is the point I keep making about our press in Nigeria. They don’t go the extra mile to investigate their stories, unlike their foreign counterparts. They rely on beer parlour and pepper soup gossips most of the time to make up their stories… Look at what was done in the report on the New York house issue. They got the name of who bought the house, when, where, how much was paid etc. But, here you don’t take the pains to do that. That is why most times you are precise but not accurate. They keep saying I own this and that property or company all over the place, but all you need to do is to go to CAC and find out who owns what. But nobody bothers to find out anything. That’s bad.

"Any way, I still have faith in this country, despite what the press is doing. The press is not totally bad. But I believe they need to go the extra mile to investigate stories and not rely on hearsay most of the time. See, for example, what the foreign press have done in the New York house issue. They gave details and tried to provide evidence. But in Nigeria, it is usually wild allegations."

The president’s son wouldn’t be drawn into detailed discussion on the allegation against the said ‘Olu Obasanjo’ or any discussion on the impropriety of the president’s son who graduated barely a year ago from university owning a mansion worth over N78million, in
a country where per capital income is a paltry 65 cents a day for majority of the over 120million impoverished citizenry.

Gbenga himself had, in the past, been accused of cutting high-profile deals, cashing in on his advantage as the president’s son. But he has consistently denied over-reaching himself or soiling his garment in corrupt practices.

PRESIDENT Olusegun Obasanjo
yesterday asked a Federal High Court, Abuja to dismiss a suit filed against him by Chief Gani Fawehinmi (SAN) over the May 14, 2005 fund raising for the Olusegun Obasanjo Presidential Library (OOPL).

In a submission made by his counsel, Chief Afe Babalola (SAN), the President said Section 308 of the 1999 Constitution protects him from any legal action while in office.

The section gives immunity to the President, Vice President, Governors and Deputy Governors against civil and criminal proceedings.

Gani had dragged the President to court over an estimated N6.5 billion donations realised at the fund raising ceremony of the OOPL claiming that Obasanjo had used his official position to force all major government contractors to donate money to his private project.

He also stated that contrary to claims by the President, the directors of OOPL were serving public officers, thus violating the constitution on such matters.

But arguing his preliminary objection in court yesterday, Chief Babalola stated that Gani had no legal rights (locus standi) to institute the action as he failed to state the special rights infringed upon.

He also stated that being a presidential candidate on the platform of National Conscience Party (NCP) in the 2003 general elections as well as the claim that he (Gani) is a Senior Advocate of Nigeria (SAN) did not entitle him to file the suit, as his private life had not been infringed upon.

Similarly, Obasanjo contended that the five reliefs where the plaintiff claimed sections 15(5) and 23 of the constitution had been violated did not disclose any cause of action in that they did not violate Chapter II of the Constitution.

Obasanjo also stated that under Section 308 of the Constitution, the President is immune from civil or criminal prosecution while in office.

He explained that given the scenario, the suit by Chief Fawehinmi was an abuse of court process in that the fact that "one is a lawyer does not give him the licence to provoke, insult, scandalise or annoy his adversary."

He said that the affidavit sworn to by Chief Fawehinmi in support of the claims violated the letters of Section 204 of the Evidence Act.

"As earlier submitted, where a party’s private right has not been violated in any way, it is an abuse of court process to come to court.

"In this case, the applicant’s affidavit does not show that he has locus standi. In the circumstance, the plaintiff ought to have withdrawn his action," he stated.

He added that having commenced the suit by originating summons, Section 2 (9) of the Public Officers Protection Act had been violated.
